By accessing or using PawnForward (the "Service"), operated by Digital Apptivity, LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
PawnForward is a chess study tracking platform that allows users to log study sessions, track progress, set goals, and manage homework assignments. The Service is available via web application and mobile application.
3. User Accounts
3.1 Registration
You must create an account to use most features of the Service. You agree to provide accurate information and keep your account credentials secure.
3.2 Account Responsibility
You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
3.3 Age Requirements
You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.
4. Subscriptions & Payments
4.1 Free and Paid Plans
The Service offers both free and paid subscription plans. Paid plans provide additional features and higher usage limits.
4.2 Billing
Paid subscriptions are billed on a recurring basis (monthly or yearly). Payments are processed through Stripe (web) or through Apple/Google in-app purchases (mobile).
4.3 Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are handled according to the policies of the payment platform used (Stripe, Apple App Store, or Google Play Store).
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious code or content
- Impersonate another person or entity
- Scrape, crawl, or use automated means to access the Service without permission
- Use the Service to harass, abuse, or harm others
6. Intellectual Property
6.1 Our Content
The Service, including its design, code, graphics, and content, is owned by Digital Apptivity, LLC and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.
6.2 Trademarks
PawnForward, the PawnForward logo, and related marks are trademarks of Digital Apptivity, LLC. You may not use our trademarks without prior written consent.
7. User Content
7.1 Your Data
You retain ownership of the data you submit to the Service (study sessions, notes, goals, etc.). By using the Service, you grant us a limited license to store, process, and display your data as necessary to provide the Service.
7.2 Content Standards
Any content you submit must comply with our Acceptable Use policy. We reserve the right to remove content that violates these Terms.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
9. Disclaimers & Limitation of Liability
9.1 As-Is Service
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2 Limitation of Liability
To the maximum extent permitted by law, Digital Apptivity, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.
10. Termination
10.1 By You
You may terminate your account at any time by deleting your account through the Service settings or by contacting us.
10.2 By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with reasonable notice.
10.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy and data retention practices.
11. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws provisions. Any disputes shall be resolved in the courts of the State of Florida.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Tactics Training
13.1 Puzzle Content
Our chess puzzles are sourced from the Lichess puzzle database, which is released under the Creative Commons CC0 (public domain) license. We do not claim ownership of the underlying puzzle positions.
13.2 Fair Play
Users are expected to solve puzzles independently. Using chess engines or external assistance during puzzle sessions undermines the training value and may result in inaccurate performance tracking.
13.3 Rating System
Tactics ratings are calculated using a Glicko-inspired system for personal progress tracking purposes. These ratings are internal to PawnForward and may not correspond to official chess ratings from FIDE, USCF, or other organizations.
